Dras E Imam, Shariath

“Bismillahir Rahmannir Raheem””Al-Hamdu Lillaahi Rabbil ‘Aalameen was Salaatu was- Salaamu ‘Alaa Sayidinaa Muhammadin wa Aalihi wa Asabihi Ajma ‘een (tauheed- risalat- ahkirat and islam-iman-ihsan)

It is a rule of Shariah that placing sacred things in what is impure (najaasat) is Haraam. However, if a person places these sacred things due to a need in a pure place with a good intention, doing so will not become impermissible merely on the possibility of it becoming soiled. There are many examples of this.

Zam-Zam is sacred water. To make istinjaa with it is Haraam, but to drink it is allowed.

To write Quranic ayats, wash it and thereafter drink it is correct.

It is permissible to drink the urine of the Holy Propheteven though it is formed by entering the stomach and leaving the body as such.

Hadrat Umar (ra)wrote ‘Hubisaa fi-Sabeelillah’ on the thighs of the horses of Astabul, even though there is a strong fear of drops of urine touching the thighs. Horses also lay on impure surfaces, but this had no bearing. Based on this proof, Imam Naseer (ra)ا and Imam Saffaar (ra)ا, who are two eminent scholars, and Imaams of the Hanafi muzhab, ruled that it is permissible to write the Kafani, etc. With regards to the statement of Shaikh Ibn Hajar (ra)ا (“This writing of Hadrat Umar (ra)on the horses was for differentiation. Thus, the ruling of this has changed”}, this is incorrect because although there are different intentions, the letters that were written are the same. The ruling of the letters {Huroof} does not change due to the difference in intention.

Actually, this incident proves the permissibility of Kafani because Rasoolullah(saws)dressed the Hypocrite with his blessed shirt as Kafani. From this, we see that without Imaan, these sacred relics (Tabarruks) do’ not give benefit to the deceased. We too believe that Kafani is beneficial to a deceased who is a Mu’min, not a Kaafir. Of course the Prophetknew that Abdullah bin Ubai was a Hypocrite (Munaafiq). In fact, it was through him revealing this that we know he was one! He also knew that this will give no benefit to the one who has no Imaan, because all of this deals with Beliefs (Aqaaid) and it is necessary for the Holy Prophetto have knowledge of this. When a farmer is able to recognize fertile and barren land for farming, why can’t the Nabi know and understand the land of Imaan (the human heart)? There are three reasons why Rasoolullahgave Abdullah bin Ubai (ra)these relics,

1. Abdullah bin Ubai’s son was a sincere Mu’min and pleasing him was intended by this.

2. Once, this Hypocrite gave his shirt to Hadrat Abbas (ra)to wear. Rasoolullahwanted to free his uncle of this debt.

3. The Holy Prophetdemonstrated that he was the Mercy to the Worlds (Rahmatulil-Aalameen) in this incident. He is ready to show mercy to everyone, irrespective of whether a person takes his guidance or not.

A cloud rains down on every kind of earth, but solid, mountainous regions take no benefit from it. The fragments of the Holy Prophetcannot enter Jahannam whilst remaining in their state. Surely the angels didn’t even let the Hypocrite’s mouth take in the blessed saliva – they must have removed it. Kan’aan, the son of Hadrat Nuh (as), will enter Jahannam in the complete adult form. Why? Because only when the semen (nutfaa)

turns into something else, then will it enter Jahannam in this new state. On the other hand, when Hadrat Talha (ra)drank the blood of the Holy Prophetafter cupping, the Prophet(saws)said, “The fire of Jahannam is Haraam upon you.”

Imam Ibn Hajar al – Haytami(in his Zawajir) quotes the hadith from Ahmad, Bukhari and Muslim that the Prophet said: “May Allah curse the Jews and Christians; they have taken the tombs of their prophets as places of worship.”

He said, “The reason for considering it an enormity is obvious

He explains, however, that, “Taking a grave as a place of worship means to pray on the grave or towards it.The prohibition, moreover, applies exclusively to the grave of someone venerated… under the two conditions:

A) that the grave is of someone who is honored and venerated;

B) and that the prayer is performed towards or on the grave with the intention of gaining the blessing of it, or out of reverence for it. (from: al-Zawajir, Reliance w21)

And this is only if one prays so close to it that if praying the prayer of those attentive (looking down), the grave would be within one’s sight.
Hence praying salat towards the grave or doing sajda infront of it as christians/jews used to do it is haram. No one is history of Islam took this hadith as proof of prohibiting building of tombs/shrines over Pious muslims graves.

Thus did We make their case known to the people, that they might know that the promise of Allah is true, and that there can be no doubt about the Hour of Judgment. Behold, they dispute among themselves as to their affair. (Some) said, “Construct a building over them”: Their Lord knows best about them: those who prevailed over their affair said,”Let us surely build a place of worship over them.” (Quran 18/21

Tafsir-Qadhi Thana Ullah Panipatti (Rahimuhullah) writes in his great Tafsir al Mazhari: After the death of Ashaab al Kahf a dispute occurred between Muslims and non-muslims, The Muslims said that they will make a Masjid over them because they were of our faith whereas the disbelievers said they will build other buildings on it where people will live….This Ayah is proving that Mosques could be made near graves of Awliya in order to say salaat in them, Tabarruk is also attained through the tombs of Awliya [Tafsir al Mazhari Volume No.7, Page No. 123-124]

Attach to masjid means remembering Allah

Softness of heart =enlightened face.

Ghair/desires-that which will take you away from Allah

Wali/friend-that will take you close to Allah.

When I want to talk to allah I say prayers and when I want that he talk to me I recite quran- Hazrath Ali(ra)
